NJ Child Care Facilities – Indoor Environmental Health Assessments for Facility Licensing
Starting in 2007, NJ is requiring all Child Care Centers to have an IEQ study of their facility
A new ruling by the New Jersey Department of Children and Families (DCF), Health and Senior Services (DHSS) amends N.J.A.C 10:122-5.2(i) for the licensing of all child care facilities. This amendment addresses the possibility of environmental health concerns that may exist on the property or nearby. Child care facilities already in operation must complete an Indoor Environmental Health Assessment (IEHA) to evaluate conditions inside of their building that may impact the health of children and workers. The IEHA must evaluate the whole indoor environment; not just indoor air. The IEHA includes an evaluation of the historical uses and operations of the building as well as current activities which may impact the indoor environment. In addition to the IEHA, any new facilities seeking an operator’s license, must conduct a Preliminary Site Assessment (PA) to determine current and former uses of the property to identify if contaminated soil and/or groundwater may being present on the site due to its historical use. The PA must be completed according to state requirements in order for the NJ Department of Environmental Protection’s (NJDEP) to issue a “No Further Action Letter” for the property.
The requirements maintain that, at a minimum, a qualified consultant should review the building's history, its current operation, neighboring businesses and anything else that could impact the indoor environment. Child care centers located in a complex that also contains dry cleaners or nail salons are required to do indoor air monitoring to look for hazards. Lead and asbestos testing must also be conducted if the building is old enough to cause this to be a potential issue. The state even goes so far to say that if the center is located near a gas station that soil and groundwater testing may be needed in case of leaking USTs.
